Terms & Conditions of Speack App

1. Acceptance of Terms

By accessing or using the Speack app ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the App. Continued use of the App signifies your acceptance of any revised terms.

2. User Conduct

• a. Users must comply with all applicable laws and regulations, including local, national, and international laws.
• b. Users shall not engage in any unlawful activities on the platform, including but not limited to harassment, fraud, or defamation.
• c. Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
• d. Users must not post any content that is abusive, threatening, obscene, defamatory, or otherwise objectionable.
• e. Users must not upload or distribute viruses, malware, or any other malicious software that may harm the App or its users.
• f. Users must not impersonate any person or entity or falsely state or otherwise misrepresent their affiliation with a person or entity.

3. Content and Intellectual Property

• a. Users retain ownership of content they post on Speack but grant Speack a worldwide, non-exclusive, royalty-free license to use, distribute, and display such content.
• b. Users must respect the intellectual property rights of others, including copyrights, trademarks, and other proprietary rights.
• c. Users shall not upload any content that infringes on the intellectual property rights of others.
• d. Speack may remove content that violates these terms or is deemed inappropriate.
• e. Users grant Speack the right to modify, adapt, or edit their content for clarity or formatting purposes without altering the original meaning.
• f. Users are encouraged to report any violations of intellectual property rights to support@speack.app.

4. Privacy Policy

• a. Users agree to the terms outlined in the Privacy Policy.
• b. Speack collects and uses user data as outlined in the Privacy Policy, which may include personal information, usage data, and other details to enhance user experience and improve the App's functionality.
• c. Users have the right to access and control their personal information as described in the Privacy Policy.

5. Prohibited Activities

• d. Users are prohibited from using the App for any illegal or unauthorized purpose.
• e. Users shall not engage in any activity that could harm or disrupt the App or other users' experience.

6. Termination

• a. Speack reserves the right to terminate accounts for violations of these Terms & Conditions without prior notice. Users may also terminate their account at any time by contacting Speack support.
• b. Upon termination, users' access to the App will be revoked and any content they have posted may be deleted.
• c. Users are responsible for any activity conducted under their account up to the point of termination.
• d. Termination does not limit Speack's right to pursue any available legal or equitable remedies.

7. Limitation of Liability

• a. Speack is not liable for the actions of users or for any content posted by users.
• b. Speack is not responsible for the accuracy, completeness, or reliability of user-generated content.
• c. Speack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the App.
• d. Speack's total liability to users for any claims arising from the use of the App is limited to the amount paid by the user, if any, for accessing the App.
• e. Users acknowledge that Speack is provided "as is" and "as available" without any warranties of any kind, either express or implied.

8. Indemnification

Users agree to indemnify and hold harmless Speack, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from their use of the App or violation of these Terms & Conditions.

• a. This indemnification obligation will survive the termination of your Speack account and these Terms & Conditions.

9. Changes to Terms

• a. Speack may update these Terms & Conditions from time to time. Users will be notified of changes through the App or via email. Continued use of the App after changes are made constitutes acceptance of the new terms.
• b. Users are encouraged to review the Terms & Conditions periodically to stay informed of updates.

10. Governing Law

• a. These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Speack operates, without regard to its conflict of law principles.
• b. Any legal action or proceeding related to these Terms & Conditions shall be brought exclusively in the courts located in the jurisdiction where Speack is headquartered.

Dispute Resolution

• a. Any disputes arising out of or in connection with these Terms & Conditions shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration body.
• b. The arbitration shall take place in the jurisdiction where Speack is headquartered, and the language of arbitration shall be English.
• c. Each party shall bear its own costs and expenses in connection with the arbitration.

Severability

• a. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• b. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

Waiver

No waiver of any term of these Terms & Conditions shall be deemed a further or continuing waiver of such term or any other term, and Speack's failure to assert any right or provision under these Terms & Conditions shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms & Conditions, along with the Privacy Policy, constitute the entire agreement between you and Speack regarding the use of the App and supersede any prior agreements between you and Speack relating to your use of the App.
